Terms of Service

NorCal Auto Fair provides advertising and display services only: we publish vehicle listings online and host physical fair weekends where listed vehicles are displayed. We are not a party to, and do not broker, arrange, negotiate, process, or guarantee, any vehicle sale. All negotiations, payments, title transfers, and DMV paperwork occur directly between buyer and seller. We are not an automobile dealer and make no representations about any vehicle's condition, value, safety, legality, or fitness for any purpose.

By creating an account and listing a vehicle, you represent and warrant that:

• You are at least 18 and can form a binding contract;
• You own the vehicle or are legally authorized to sell it;
• All listing information is accurate and not misleading, including the title status;
• The VIN you provide is the vehicle's genuine VIN;
• Photos you upload are of the actual vehicle listed and you have the right to use them.

The listing fee (currently $139 per vehicle) is a one-time, non-refundable display/listing fee. It is not a commission, deposit, or brokerage fee, and it is not contingent on your vehicle selling. Once a vehicle's fee is paid, registering that vehicle for fair weekends is free. Fees may change prospectively; a changed fee never applies retroactively to already-paid vehicles.

Display space at fair weekends is limited. Registering a vehicle for a weekend and failing to bring it ("no-show") takes space from other sellers. You may withdraw a registration free of consequence until the posted cutoff (currently the Friday before the weekend at 6:00 PM Pacific).

Registering vehicles you do not actually bring to the fair is grounds for account suspension or closure at our sole discretion. No-shows are tracked as strikes on your account: a first strike results in a warning email; a second places your account in warned status; a third results in suspension pending review. We may adjust these thresholds, and we may waive strikes for documented emergencies.

You retain ownership of the photos and text you upload. You grant NorCal Auto Fair a non-exclusive, royalty-free, worldwide license to host, reproduce, resize, display, and distribute that content to operate the service, and to use it in our marketing and promotion of the fair (for example, featuring your listing on our home page or in promotional material). This license ends for content you delete, except where the content already appears in published marketing materials.

• Listing a vehicle with a false or altered VIN, or misrepresenting title status;
• Listing stolen vehicles or vehicles you have no right to sell;
• Harassment of buyers, sellers, or staff, online or at the fair;
• Scraping, bulk-harvesting, or reselling site data;
• Attempting to interfere with the operation or security of the site;
• Using the site for any unlawful purpose.

We may remove any listing, or warn, suspend, or close any account, at our discretion, including for violations of these terms, the no-show policy, or conduct that endangers the fair or its participants. Listing fees are non-refundable, including on termination for cause. You may close your account at any time from your dashboard; closing your account deletes your personal information as described in the Privacy Policy.

THE SITE AND THE FAIR ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT INSPECT, VERIFY, OR ENDORSE ANY VEHICLE OR SELLER. VEHICLE HISTORY DATA (INCLUDING NHTSA VIN DECODING) IS PROVIDED FOR CONVENIENCE AND MAY BE INCOMPLETE OR INACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORCAL AUTO FAIR AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM ANY TRANSACTION BETWEEN BUYERS AND SELLERS, AND OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

You agree to indemnify and hold NorCal Auto Fair harmless from claims arising out of your listings, your vehicles, your representations, or any transaction you enter with another user.

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Venue for any dispute lies in the state or federal courts located in Sacramento County, California. We may update these terms; material changes will be announced by email and by updating the version above. Continued use after the effective date constitutes acceptance.
